Welcome to Doris!
‍
Doris is a virtual assistant and social network created by Doris.MOBI, offers technologies and services to allow you, in accordance with these Terms of Use:

- create an Avatar with eligible personal characteristics, including: Your style profile, height, skin tone, eye color, hair shape and color, body shape, and other preferences, enabling a better experience when trying on Clothing Items;

- if and when available, upload Your Images and Clothing Items to virtually try on such Clothing Items;

- if and when available, upload Images of any individuals (who have authorized the use and uploading of said Image by You) so that You can view the Clothing Items of such individuals and/or discover where to buy such Clothing Items;

- if and when available, upload Images of other individuals (who have authorized the use and uploading of said Images by You) and photos of Clothing Items to show them how they would look with the outfit chosen by You;

ATTENTION! YOU MUST HAVE OBTAINED AUTHORIZATION FROM SAID INDIVIDUALS FOR THE USE AND UPLOADING OF SUCH IMAGES, OR BE AUTHORIZED TO USE THEM ACCORDING TO APPLICABLE LAW. YOU ARE SOLELY RESPONSIBLE, TO DORIS.MOBI AND/OR ANY THIRD PARTIES, FOR ALL LOSSES AND DAMAGES CAUSED TO THIRD PARTIES DUE TO THE IMPROPER USE OF IMAGES OF SUCH THIRD PARTIES.

- create a virtual wardrobe from Clothing Items, allowing You to try on such Clothing Items at any time, through your Avatar or, if and when available, through your Image;

- provide information for the construction of a Database, which will be used by Doris to form Your style profile and present You suggestions for Clothing Item combinations according to Your preferences and interests;

- receive fashion tips from Doris, tailored especially for You, according to Your preferences and interests; and

- connect with other members of the Doris Community to interact and exchange experiences, looks, messages, photos, videos, etc.

You will not be charged anything to register on Doris. Some services and technologies offered by Doris may be charged eventually, but You will be informed in advance of the charges.

We receive compensation from third parties to show advertisements for products and services to You, as well as for Doris to consider such products and services when giving fashion tips to You. But don't worry, Doris' tips will always take into account Your preferences and interests!

By using Doris, You agree that we may show ads that we consider relevant to You, based on Your profile. We use Your Personal Data to help determine your preferences and interests, as well as which ads to display.

Please note that it is very important that You read, know, and understand these Terms of Use and our Privacy and Data Protection Policy, as well as Your rights and obligations as a User.

Reading, agreeing, and fully accepting all the provisions contained in these Terms of Use and in our Privacy and Data Protection Policy are indispensable for You to register and use Doris.

These Terms of Use include the following documents (click the link to access the content):

Definitions

The following terms, whenever used or initiated in uppercase letters, shall have the following meanings:

Government Authority: means any government, authority, governmental entity, regulatory agency, public ministry, revenue authority (including, without limitation, the Brazilian Federal Revenue Service and state and municipal revenue agencies), commission, board, council, stock exchange, entities, and any foreign or national court, arbitral tribunal, court, arbitrator, tribunal, with jurisdiction, as the case may be, over Doris.MOBI and/or the Users.

Avatar: means the entirely digital cyber body created by You or other Users in the Doris Community with eligible personal characteristics, including Your style profile, height, skin tone, eye color, hair shape and color, body shape, and other preferences, to enhance your experience using Doris.

Database: means the structured set of Personal Data, established in one or several places, in physical and electronic support, generated as a result of activities carried out by Users through the use of Doris.

Doris: means the Doris.MOBI application called "Doris," through which the services and content are made available by Doris.MOBI can be accessed in accordance with these Terms of Use.

Doris.MOBI: means DORIS.MOB TECNOLOGIA S.A., the owner and/or holder of the right to use websites and applications that are part of Doris.

Personal Data: means any data related to a natural person, identified or identifiable, including, but not limited to, identifying numbers, location data, and/or electronic identifiers and IP addresses, when these are related to a natural person, or any data that, alone or in combination, allow the formation of the behavioral profile of a natural person, if identified. When referring to You, Personal Data will be understood as any Personal Data sent, made available, and/or transmitted by You through Doris.

Clothing Item: means the image of a specific, Wearable piece of clothing that allows Doris to perform its virtual projection, allowing the simulation of wearing such piece of clothing by a person/Avatar.

Community Doris: means the set of Users who, like You, transmit Content to/through Doris, interact, and share information with each other.

Sensitive Personal Data: means any Personal Data about racial or ethnic origin, religious belief, political opinion, membership of a trade union or of a religious, philosophical or political organization, Personal Data related to health or sexual life, genetic or biometric Personal Data, when linked to a natural person.

Account: means Your virtual account, automatically created upon Your registration, to record all actions implemented by You in Doris and Doris' partner sites and to allow You to identify yourself to the Doris Community. Therefore, all and any Users will have an Account.

Image: means, regarding a natural person, any forms of representation, including photographic, of the human figure, visual aspect, countenance, gestures, distinct parts of the body, externalizations of personality, name, surname, nicknames, codenames, and pseudonyms, as well as the audiovisual process resulting from the fixation of images with or without sound, which aims to create, through its reproduction, the impression of movement, regardless of the processes of its capture, the initial or subsequently used support to fix it, as well as the means used for its broadcasting, including, but not limited to (i) newspapers, magazines, pamphlets, marketing materials, catalogs, and/or any other printed means; (ii) fashion art, painting, sculpture, drawing, photography, reprography, caricature or decorative representation; (iii) sound image of phonography and broadcasting; and/or (iv) cinematography, television, and the Internet.

Applicable Law: means any law, code, decree, regulation, regulatory requirement, rule, ordinance, instruction, declaration, deliberation, resolution, judicial, arbitral, or administrative decision of any Government Authority.

Login: means a unique code that will be used at the time of registration and used for Your identification in Doris.

Privacy and Data Protection Policy: means the document entitled "Privacy and Personal Data Protection Policy" applicable to Doris and containing provisions on the Processing of Users' Personal Data, the terms of which must be fully accepted by You as a condition for Your registration.

Support: means, collectively, the channels for communication with Doris.MOBI is indicated on the website www.doris.mobi under the Support link.

Terms of Use: this document is entitled "Terms of Use," which, together with the Privacy and Data Protection Policy, contains the terms and conditions for the use of Doris by Users.

Processing: means any operations performed with Personal Data, including, but not limited to, operations of collection, production, reception, classification, use, access, reproduction, transmission, sharing, distribution, processing, filing, storage, deletion, evaluation, or control of information, modification, communication, transfer, dissemination, or extraction.

User: means, indistinctly, any natural person who registers in Doris, including You, after completing Your registration.

Wearable: means, regarding a piece of clothing, that said piece of clothing meets Doris' technical requirements so that its virtual projection can be successfully completed, allowing the simulation of wearing such piece of clothing by a person or an Avatar.

You (and, when referring to You, the pronouns "Your" and "Yours"): means the natural person who is, hereby, agreeing to these Terms of Use and the Privacy and Data Protection Policy and registering in Doris. You must: (i) have legal capacity to agree to these Terms of Use and perform all available actions in Doris or, if You are under 18 (eighteen) years old and/or do not have legal capacity, You must be assisted or represented by your parents or legal representatives, as provided by Applicable Law; (ii) provide complete, accurate, true, and updated registration information; (iii) provide, at your exclusive cost, all necessary resources for the use of Doris, such as internet access, equipment (computers, mobile phones, etc.), software, and systems (IOS, Android, etc.); and (iv) comply with all Applicable Laws regarding the use of Doris as a User

Registration:

Before completing Your registration, You must read, ensure You have understood, and accept all the terms and conditions set forth in these Terms of Use and in the Privacy and Data Protection Policy, which contains provisions regarding the collection, use, storage, processing, and protection of Your Personal Data. Acceptance of these Terms of Use and the Privacy and Data Protection Policy is essential for the completion of Your registration and use of Doris.

By registering, You declare and warrant that:

- You have the legal capacity to agree to these Terms of Use and perform all available actions in Doris or, if You are under 18 (eighteen) years old and/or do not have legal capacity, You are assisted or represented by your parents or legal representatives, as provided by Applicable Law;

- all information in Your registration is complete, accurate, true, and up-to-date;

- You will provide, at your exclusive cost, all necessary resources for the use of Doris, such as internet access, equipment (computers, mobile phones, etc.), software, and systems (IOS, Android, etc.);

- You are registering on Doris with the purpose of using Doris' functions according to these Terms of Use.

If You have been suspended by Doris.MOBI, temporarily or permanently, and are deprived of using Doris, You cannot create a new registration.

You will create a unique registration, and Your Login will be necessary for communication within Doris.

Your registration will only be confirmed and considered valid if You fill out all mandatory fields in the Doris registration with accurate and precise information. Upon confirmation of registration, You can use the services and technologies offered by Doris.

Doris.MOBI is not responsible for the correctness and truthfulness of the data entered by You in Your registration. You guarantee and are liable, at any time, civilly and criminally, for the truthfulness, accuracy, and authenticity of your registration data.

Doris.MOBI may reject any registration request that does not comply with these Terms of Use. Doris.MOBI may suspend or terminate Your Account and Your registration as provided in the Suspension and Account Termination section.

Doris.MOBI may, at its sole discretion and at any time, conduct searches it deems necessary to verify the existence of incorrect or untrue data, as well as request from You additional data and/or documents, including personal ones, that it deems relevant to verify the registration data provided.You agree to immediately notify Doris.MOBI of any unauthorized access or use of Your Login and such notification must be made in writing and directed to Doris.MOBI through our Support.

You will be solely responsible for:

- updating the information in Your registration as necessary to keep it up to date;

- not allowing others to use Your Account;

- not selling, trading, lending, or otherwise transferring Your Account to anyone;

- obtaining all necessary licenses and authorizations regarding the use of Images and/or third-party intellectual property;

- all acts or omissions You make from Your access to Doris and/or during Your use of Doris; and

- any Content You send, make available, and/or in any way transmit through/to Doris and to the other members of the Doris Community, including those related to third parties.
 

Functionality and Use of Doris

Upon registering and creating Your Account, You will have free access to Doris' functionalities and the Doris Community, provided, however, that You adhere to the conditions and limits set forth in these Terms of Use, including, but not limited to, those related to the limitations on the use of Images and third-party intellectual property and/or Doris.MOBI. You are solely responsible for Your use of Doris and the Content You provide to other members of the Doris Community, at Your own risk.

Virtual Assistant

Doris allows You to create an Avatar with eligible personal characteristics and upload Images of Clothing Items so that You can virtually try on such Clothing Items using the mentioned Avatar. This simulation is performed through the automated editing of the Clothing Item provided by You, creating a two-dimensional virtual representation of the chosen Clothing Item and editing it onto Your Avatar.When available, You can also upload Your Images so that You can virtually try on Clothing Items to Your body Image. Additionally, You can upload Images of other people to Doris so that You can virtually try on Clothing Items on those people or show those people how they would look in the outfit You have chosen. BUT BE AWARE! YOU MUST HAVE OBTAINED AUTHORIZATION FROM THESE PEOPLE TO USE AND SEND SUCH IMAGES, OR BE AUTHORIZED TO USE THEM ACCORDING TO APPLICABLE LAW. YOU ARE SOLELY RESPONSIBLE, BEFORE DORIS.MOBI AND/OR ANY THIRD PARTIES, FOR ALL LOSSES AND DAMAGES CAUSED TO THIRD PARTIES DUE TO THE IMPROPER USE OF SUCH THIRD PARTIES' IMAGES.

In this situation, for the operation to be completed, the Image sent must meet Doris' technical requirements. In any case, the Clothing Item must be Wearable, i.e., it must also meet these technical requirements.

You can save Clothing Items in Your virtual wardrobe. Doris also allows You to try on all saved Clothing Items to help You choose the best look for a particular occasion.

Doris.MOBI is working to enable Doris to identify the brand and model of some non-Wearable clothing items sent by You, either to find a representation on the web that meets the technological requirements to allow You to try them on, or to indicate places where to buy such items.

Additionally, Doris analyzes the Clothing Items sent by You and may ask questions about Your preferences and interests to build Your style profile and provide You with fashion tips, including general Clothing Item combinations. Your profile is also built from cookies and other tracking and identification mechanisms.Based on Your preferences and interests stored by Doris, Doris may send advertisements for products and services that it deems relevant to You.

Social Network

We encourage You to use Doris to communicate with other members of the Doris Community, expressing and sharing Content that is relevant to You. However, we value the security and good atmosphere among Users, so You cannot behave in any way that may, at our sole discretion, harm such security and atmosphere.

You must access and use Doris' services only for lawful, authorized, and acceptable purposes. You may not use (or assist others in using) Doris: (i) to violate, misappropriate, or infringe Doris.MOBI's, Users', or third parties' rights; (ii) unlawfully, defamatorily, or intimidatingly; (iii) involving false, incorrect, or misleading statements; (iv) to impersonate others; and/or (v) to send unauthorized or illegal messages, automatic messages, mass messages, and the like.

In particular, You may not send, make available, and/or in any way transmit inappropriate Content, including nudity, obscenity, threats, harassment, violence, insults, or offensive words (including, but not limited to, racial or ethnic terms), advocating or inciting drug use and/or other types of unlawful or violent conduct, or anything that could in any way harm the well-being of other Users of the Doris Community or cause harm to the image or honor of third parties or Doris.MOBI itself, at the sole discretion of Doris.MOBI.

You may also not use Doris abusively or in any other context that is not the intended use as per these Terms of Use or to commit crimes or offenses.

The relationships between Users are established at their own risk. Doris.MOBI does not intervene or participate in any legal relationship established between Users of the Doris Community, whether resulting from negotiations, promises, obligations undertaken, illegal acts, etc.

Messages exchanged between Users through Doris are end-to-end encrypted, which means that Doris.MOBI cannot read or access their content.

In case of a complaint from a third party, You hereby agree to and authorize the immediate transfer of Your information to such third party, without prejudice to other penalties and consequences provided in these Terms of Use, such as suspension, termination, etc.

Furthermore, You shall indemnify Doris.MOBI for all damages caused to other Users, even if, due to a court decision, Doris.MOBI is held liable for such damages to said, Users.

The usage limitations described in these Terms of Use are not intended to be exhaustive, and the inappropriate and unreasonable use of Doris may be considered by Doris.MOBI as a violation of these Terms of Use, resulting in the penalties provided herein.

Your responsibilities

YOU ARE SOLELY RESPONSIBLE FOR ALL CONTENT YOU SEND, PROVIDE, AND/OR OTHERWISE TRANSMIT THROUGH/TO DORIS AND TO OTHER MEMBERS OF THE DORIS COMMUNITY.
IF SUCH CONTENT IS SUBJECT TO ANY INTELLECTUAL PROPERTY RIGHTS OF THIRD PARTIES, YOU DECLARE THAT YOU HAVE PREVIOUSLY OBTAINED ALL NECESSARY LICENSES AND AUTHORIZATIONS TO USE SAID CONTENT IN THE MANNER YOU DO.
YOU ARE EXCLUSIVELY RESPONSIBLE FOR ALL CONTENT YOU SEND TO OTHER USERS THROUGH DORIS, AS WELL AS FOR THE EFFECTS ARISING FROM YOUR ACTIONS WITHIN THE CONTEXT OF THE RELATIONSHIP ESTABLISHED WITH SUCH USERS.
YOU DECLARE THAT YOU ARE AWARE THAT, IN THE CASE OF SENDING PHOTOS, YOU SHOULD ONLY USE AND SEND IMAGES OF THIRD PARTIES AFTER OBTAINING THEIR PREVIOUS AND EXPRESS AUTHORIZATION, OR IF YOU ARE AUTHORIZED TO USE THEM ACCORDING TO APPLICABLE LAW.
YOU ALSO ACKNOWLEDGE THAT YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE, BEFORE DORIS.MOBI AND/OR ANY THIRD PARTIES, FOR THE USE YOU MAKE OF THESE IMAGES.

Without prejudice to the other provisions of these Terms of Use, you will indemnify and hold Doris.MOBI, its respective partners, directors, employees, and contractors, as well as other Users, harmless from any and all claims, liabilities, lawsuits, actions, losses, costs, damages, charges, and expenses (including, without limitation, court costs and reasonable attorneys' fees) related to/arising from any third-party claims (including, without limitation, other users) that have as their object or result from:

- facts, acts, omissions, and/or circumstances occurring at any time (including, but not limited to, civil, commercial, consumer, criminal, tax, labor, and social security contingencies and/or liabilities) arising from procedures adopted by You;

- Your breach of any provisions of these Terms of Use, the Privacy and Data Protection Policy, and any other contract or document You have entered into with Doris.MOBI;

- Your breach of any legal provision or any obligation assumed within the relationship maintained with other Users; and/or

- Your violation of any trademark, image, and/or intellectual property right of Doris.MOBI, any other Users, and/or any third parties.

You shall also compensate/indemnify all direct or indirect damages You cause to Doris.MOBI, any other User of the Doris Community, and/or any third party, due to any act performed from Your access to Doris and/or acts performed as a User, as per these Terms of Use.

 

Doris Disclaimer

You acknowledge and agree that Doris.MOBI, its partners, directors, representatives, employees, and contractors will not be liable for any damage arising from: (i) any Content you send, provide, and/or otherwise transmit; (ii) the violation of any statements made and/or any other provisions of these Terms of Use by you or any other Users; (iii) intentional or negligent acts, commissions, or omissions by you, other Users, or any third party; (iv) the use of your Account by third parties; and/or (v) the violation, by you or any other Users, of any Applicable Law.

Under no circumstances shall Doris.MOBI, its partners, directors, representatives, employees, and contractors be liable for: (a) lost profits, loss of production, work stoppage, business failures, loss of opportunity, loss of data, or any indirect, special, incidental, consequential, or punitive damages; (b) the flaws or defects of Doris or incomplete, inaccurate, false, misleading, and/or outdated information provided by other Doris Users; (c) any damages (direct or indirect), losses, or costs incurred or paid by you, resulting from or in any way related to your access, viewing, or use of Doris, or the delay or impossibility of accessing, viewing, or using Doris; (d) any personal injury, death, bodily harm, property damage, or any other damages (direct or indirect), losses, or costs incurred, suffered, or paid by you, arising from acts, statements, warranties, errors, infringements, negligence, improper conduct, intentional or not, omissions, non-compliance, false information, and/or offenses committed, carried out, or provided by other Users (their employees, professionals, directors, agents, representatives, or affiliated companies) or third parties; (e) the deletion, failure of storage, or failure of transmission of any communication or content maintained by Doris; and/or (f) the capacity of the Users to enter into contracts.

Doris.MOBI will also not be liable: (a) for any act or omission performed and/or damage caused by you resulting from your access to Doris; (b) for any effect or implication arising from the relationship established between you and other Users through Doris; (c) for the improper use that any User or third party makes of Doris and/or the Content uploaded, sent, and/or transmitted to/from Doris and to other members of the Doris Community; and (d) for failures, technical impossibilities, or unavailability of any systems, including those integrated into Doris.

Doris.MOBI will use its best efforts to keep Doris accessible securely, uninterrupted, and free from any interruptions or failures. However, you acknowledge that Doris.MOBI does not guarantee that Doris will operate without interruptions or malfunctions. In particular, Doris's operation may be interrupted for maintenance, updates, or problems in the system or network. Doris.MOBI does not guarantee that Doris can be accessed through all existing wireless services or available data services, nor in all geographical locations.

Doris.MOBI disclaims any responsibility for: (a) events resulting from any interruption or malfunction of Doris; (b) any malfunction, inability to access, or inappropriate conditions of use of Doris due to improper equipment, problems associated with internet service providers, internet network saturation, or any other reason; and (c) any virus that may affect your equipment as a result of accessing, using, or browsing the internet or due to the transfer of data, files, images, texts, videos, or audio.

Doris.MOBI is not responsible for technical and/or operational flaws or defects arising from User or third-party systems, equipment, or infrastructure.

In no event shall Doris.MOBI be liable for lost profits or any damages you may suffer due to the inability to use Doris, regardless of the reason for such inability

Intellectual property

You acknowledge that Doris.MOBI is the owner and/or licensee of all intellectual property rights related to Doris, protected by Applicable Law.

You acknowledge and agree that you shall not:
‍
- copy, reproduce, alter, or modify Doris or any of its screens;

- create products or services derived from Doris;
‍
- use any device, software, or other resource that may interfere with Doris's activities and operations, as well as its ads, descriptions, accounts, or databases;

- transmit or make available, by any means, any virus, spyware, code, feature, or program intended to damage or impair Doris's operation or any equipment connected and/or with access to Doris;

- access, monitor, or copy any content or information from Doris using a robot, spider, scraper, or other automated means for any purposes without Doris.MOBI's prior express written permission;

- incorporate any part of Doris into any other website through framing, mirroring, or any other means;

- reverse engineer, decompile, or disassemble Doris, any of its applications, or Doris.MOBI's websites; and/or

- otherwise violate and/or claim and/or impair the use of intellectual property rights over Doris, under any title and at any time.

The commercial use of the expressions "DORIS," "Comunidade Doris" or "Doris.MOBI" as a trademark, trade name, or domain name, as well as the content on Doris's screens, programs, the "look and feel" of Doris, the database resulting from Doris's operation, the networks, and files allowing you to access and use Doris are Doris.MOBI's exclusive property is protected by international laws and treaties on copyright, trademarks, patents, models, and industrial designs, so you have no rights over any of these intellectual property items. Misuse and total or partial reproduction of said content without Doris.MOBI's authorization is expressly prohibited.

Doris may contain links to third-party websites, which does not imply that these websites are owned or controlled by Doris.MOBI or operated by it. Without control over these third-party websites, Doris.MOBI shall not be responsible for their contents, practices, products, and/or services offered. The presence of links to other websites does not imply any partnership, supervision, complicity, or solidarity between Doris.MOBI and the third parties owning these websites and their contents.

Any intrusion, attempt, or activity that violates or contradicts the Applicable Laws on intellectual property rights and/or the prohibitions stipulated in these Terms of Use will make the responsible party liable for the relevant legal actions, as well as the sanctions provided herein, and they shall also be liable for compensation for any damages caused.

You expressly acknowledge that by sending/transmitting/uploading any Content through/to Doris and the Comunidade Doris, you are granting Doris.MOBI express, free, non-exclusive, irrevocable, and non-retractable authorization to use all and any intellectual property rights (including copyrights and related rights) related to such Content sent/transmitted/uploaded by you to Doris, by any means or form, at its sole discretion, without any restrictions or limitations of any kind. You declare and warrant that the mentioned Content will not infringe third-party rights, and you will have all necessary authorizations for the sending/transmission/uploading of said Content.
 

Terms of Use Update

Doris.MOBI may change these Terms of Use at any time and for any reason. In the event of a change to the Terms of Use, the date at the top of these Terms of Use will also be updated by Doris.MOBI.

If the disclosure is made through Doris, you must agree to the new version of these Terms of Use to continue using Doris, and the new Terms of Use will become effective on the date of your expressed agreement.

The new Terms of Use will become effective 5 (five) calendar days after their disclosure. Within that period, you must notify Doris.MOBI, if you do not agree with the amended terms, and such communication, must be made in writing and addressed to Doris.MOBI through our Support. Upon receipt of such communication, Your Account will be terminated, and the contractual relationship between You and Doris.MOBI will cease to exist. If no communication is received within the specified period, it will be deemed that you have accepted the new Terms of Use.

Doris.MOBI will maintain the updated version of these Terms of Use on Doris so that you can consult them at any time.
 

Account suspension or termination

Without prejudice to other measures, Doris.MOBI may suspend or terminate Your Account at any time without notice, and without incurring any cost or penalty, if:

- You violate any provision of (i) these Terms of Use, (ii) the Privacy Policy and Data Protection, and/or (iii) any other document You have agreed upon with Doris.MOBI;

- You engage in fraudulent, simulated, or intentional acts;

- You remain inactive for more than one year;

- Doris.MOBI suspects any illegitimacy, fraud, or any other act contrary to the provisions of these Terms of Use;

- Any information provided by You on Doris is incorrect, untrue, outdated, or cannot be verified and/or confirmed by Doris.MOBI;

- You do not agree to the changes in these Terms of Use made by Doris.MOBI, as outlined in the Update section of these Terms of Use; 

- You create more than one Account;

- You transmit any Sensitive Personal Data or Personal Data of a child or teenager (unless You are the child or teenager in question and are duly assisted or represented by your parents or legal guardians, as per the Applicable Law) through Doris; and/or

- You request the Deletion of your Personal Data and/or revoke the consent granted to Doris.MOBI for the Processing of Your Personal Data, as per the Privacy Policy and Data Protection

- In the case of Doris.MOBI receives any complaint from a third party alleging that You have violated these Terms of Use, the Privacy Policy and Data Protection, and/or any Applicable Law.

The suspension or termination of Your Account does not prevent the adoption of legal actions that may result from the possible configuration of civil or criminal offenses or damages to Doris.MOBI or third parties.

You may terminate Your Account at any time without incurring any cost. The termination of the Account by You must be done by sending an email to our Support.

If Your Account is suspended or terminated, Doris.MOBI may, at its sole discretion, suspend access or delete (as the case may be) any or all information from Your Account, except for Personal Data, in accordance with the Applicable Law and the Privacy Policy and Data Protection.
 

General provisions

You may not assign and/or transfer any of your rights and obligations established in these Terms of Use without the prior written consent of Doris.MOBI. In the absence of any prior written consent, any attempt to assign and/or transfer shall be deemed null, void, and ineffective.

Doris.MOBI may, at its sole discretion, assign and/or transfer any of its rights and obligations established in these Terms of Use to third parties, without Your consent.

Partial exercise or non-exercise, granting of time, tolerance, or omission in exercising any right granted to Doris.MOBI in these Terms of Use and/or by the Applicable Law shall not constitute novation or waiver of such right, nor shall it impair its enforcement.

The nullity or invalidity of any provision of these Terms of Use shall not imply the nullity or invalidity of the others.

These Terms of Use shall be governed and construed in accordance with the laws of the Federative Republic of Brazil, and to settle any disputes arising directly or indirectly therefrom, the Forum of the District of São Paulo, State of São Paulo, is hereby elected, with the express waiver of any other, no matter how privileged it may be or become.

In this Policy, you will find a description of the processing activities of Your Personal Data that are essential for the operation of Doris and the provision of our services.

To function, Doris requires various Personal Data to be provided by You, which are processed and used to enable and improve the provision of services by Doris.MOBI, as well as to identify Your preferences to present advertisements that may interest You.

When You use our services and products, You provide Doris.MOBI with information and Personal Data through Your registration, the submission of Content, messages, and interaction with other Users, sending images, the Content You view when using Doris, the creation and characterization of the Avatar, and the use of features on Your smartphone, such as the camera, memory, location, among others, which are used to establish Your style profile, which, in turn, will serve as the basis for Doris to suggest combinations of clothing items to You.

Other individuals who also use Doris may send Content that may include Your Personal Data. In these cases, Doris acts solely as the processor of such Personal Data, processing them to enable the activities and functionalities of Doris.

Doris.MOBI does not sell Your Personal Data to third parties. It is essential that You read the provisions of this Policy to understand how we collect and process Your Personal Data.
 

Meaning of Expressions Used in These Terms

The expressions below, whenever used or initiated in uppercase letters, shall have the following meanings:

Governmental Authority: means any government, authority, governmental entity, regulatory agency, public prosecutor's office, revenue authority (including, without limitation, the Federal Revenue Service of Brazil and state and municipal tax authorities), commission, board, council, stock exchange, bodies, and any court, arbitral tribunal, court, foreign or national, with jurisdiction, as the case may be, over Doris.MOBI and/or Users, including, but not limited to, the National Data Protection Authority (if and when created).

National Data Protection Authority: means the body of the indirect public administration responsible for ensuring, implementing, and overseeing compliance with LGPD (if and when created).

Database: means the structured set of Personal Data established in one or several locations, in physical and electronic support, generated as a result of activities carried out by Users through the use of Doris.

Blockage: means the temporary suspension of any Processing operation, by keeping Personal Data or the Database.

Doris Community: means the set of Users who, like You, transmit Content to/through Doris, interact, and share information with each other.

Account: means Your virtual account, automatically created upon Your registration, to record all actions implemented by You in Doris and to allow You to identify yourself to the Doris Community. Therefore, all Users will have an Account.

Controller: means the natural or legal person, public or private, to whom decisions regarding the Processing of Personal Data belong. Doris.MOBI is the Controller responsible for making decisions regarding the Processing of User's Personal Data.

Content: means any and all content sent, made available, and/or otherwise transmitted by You or other Users in the Doris Community.

Anonymized Data: means any data related to an individual that cannot be identified, considering the use of reasonable and available technical means at the time of its Processing. Anonymized Data will not be considered Personal Data for the purposes of this Policy, except when the anonymization process to which they have been submitted is reversed, using exclusively their own means, or when, with reasonable efforts (as defined by the Applicable Law), it can be reversed.

Personal Data: means any data related to a natural person, identified or identifiable, including, but not limited to, identifying numbers, images, location data, and/or electronic identifiers and IP addresses when these are related to a natural person, or any data that, alone or in conjunction, allows the behavioral profile of a natural person to be formed if identified. When referring to You, Personal Data will be understood as any Personal Data sent and/or transmitted by You through Doris.

Sensitive Personal Data: means any Personal Data about racial or ethnic origin, religious belief, political opinion, membership in a union or religious, philosophical, or political organization, Personal Data relating to health or sexual life, genetic, or biometric Personal Data, when linked to a natural person.

Doris: means the Doris.MOBI application called "Doris," through which the services and content are made available by Doris.MOBI according to the Terms of Use can be accessed.

Doris.MOBI: means DORIS.MOBI TECNOLOGIA S.A., the owner and/or holder of the right to use the websites and applications that integrate Doris.

Deletion: means the removal of Personal Data or a set of Personal Data stored in a Database, regardless of the procedure used.

Image: means, concerning a natural person, any forms of representation, including photographic, of the human figure, visual aspect, countenance, gestures, distinct parts of the body, externalizations of personality, name, surname, nicknames, codenames, and pseudonyms, as well as the audiovisual process resulting from the fixation of images with or without sound, which aims to create, through its reproduction, the impression of movement, regardless of the processes used for its capture, the initial or subsequent support used to fix it, as well as the means used for its broadcasting, including, but not limited to (i) newspapers, magazines, brochures, marketing materials, catalogs, and/or any other printed means; (ii) fashion art, painting, sculpture, drawing, photography, reprography, caricature or decorative figuration; (iii) sound image of phonography and broadcasting; and/or (iv) cinematography, television, and the Internet.

Applicable Law: means any law, code, decree, regulation, regulatory requirement, rule, ordinance, instruction, statement, deliberation, resolution, judicial, arbitral, or administrative decision of any Governmental Authority, including, but not limited to, LGPD (from its effective date).

LGPD: means Law No. 13,709/2018 and its respective regulations that may be created, as amended from time to time.

Login: means Your mobile number, indicated by You at the time of registration and used for Your identification in Doris.

Operator: means the natural or legal person, public or private, resident or headquartered inside or outside the national territory, who performs the Processing of Personal Data on behalf of the Controller.

Clothing Item: means the image of a specific clothing item, Wearable, that allows Doris to make its virtual projection, allowing the simulation of the use of such clothing item by a person.

Policy: means this document entitled "Privacy Policy and Personal Data Protection," which contains provisions on the Processing of User's Personal Data, whose terms must be fully accepted by You as a condition for Your registration.

Support: means the channels for communication with Doris.MOBI indicated in Doris, in Profile/Support.

Terms of Use: means the document entitled "Terms of Use," which, together with this Policy, contains the general terms and conditions for the use of Doris by Users.

International Transfer of Personal Data: means the transfer of Personal Data to a foreign country or international organization of which the country is a member.

Processing: means any operation carried out with Personal Data, including, but not limited to, operations of collection, production, reception, classification, use, access, reproduction, transmission, sharing, distribution, processing, archiving, storage, deletion, evaluation, or control of information, modification, communication, transfer, dissemination, or extraction.

Shared Use of Personal Data: means the communication, dissemination, international transfer, interconnection of Personal Data, or shared Processing of Databases by public entities and agencies in the fulfillment of their legal competencies, or between these and private entities, reciprocally, with specific authorization, for one or more modalities of Processing allowed by these public entities, or between private entities.

User: means, indistinctly, any natural person who registers in Doris, including You, after completing Your registration.

Wearable: means, concerning a piece of clothing, that said clothing item meets Doris's technical requirements for it to be possible to successfully complete its virtual projection, allowing the simulation of the use of such clothing item by a person.

You (and, when referring to You, the pronouns "Your" and "Yours"): means the natural person who is, hereby, agreeing to the Terms of Use and this Policy and registering in Doris. You must: (i) have legal capacity to agree to these Terms of Use and to perform all actions available in Doris, or if You are under 18 (eighteen) years old and/or do not have legal capacity, You must be assisted or represented by Your parents or legal guardians, according to the Applicable Law; (ii) provide complete, accurate, true, and updated registration information; (iii) provide, at Your exclusive cost, all resources necessary for the use of Doris, such as internet access, equipment (computers, mobile phones, etc.), software, and systems (iOS, Android, etc.); and (iv) comply with all Applicable Laws regarding the use of Doris as a User.
 

User Consent for the Processing of Personal Data

To use Doris, you need to grant us specific authorizations:

YOU EXPRESSLY CONSENT TO DORIS.MOBI, ON ITS OWN BEHALF OR THROUGH OPERATORS, PERFORMING OPERATIONS OF INTERNATIONAL TRANSFER OF YOUR PERSONAL DATA AND INFORMATION, IN ACCORDANCE WITH THIS POLICY AND APPLICABLE LAW, FOR THE PURPOSES OF (A) ALLOWING YOU TO USE THE SERVICES OFFERED BY DORIS.MOBI THROUGH DORIS; (B) COMPLYING WITH THE OBLIGATIONS ASSUMED BY DORIS.MOBI UNDER THE TERMS OF USE; AND (C) MAINTAINING, PROTECTING, AND IMPROVING THE SERVICES PROVIDED.

YOU DECLARE THAT YOU HAVE OBTAINED ALL PRIOR AND EXPRESS AUTHORIZATIONS FROM THIRD PARTIES WHO ARE HOLDERS OF THE PERSONAL DATA PROVIDED BY YOU TO DORIS.MOBI, FOR COLLECTION, PRODUCTION, RECEPTION, CLASSIFICATION, USE, ACCESS, REPRODUCTION, TRANSMISSION, SHARING, DISTRIBUTION, PROCESSING, ARCHIVING, STORAGE, DELETION, EVALUATION, OR CONTROL OF INFORMATION, MODIFICATION, COMMUNICATION, TRANSFER, DISSEMINATION, OR EXTRACTION, AND IN SHORT, ANY AND ALL PROCESSING OF PERSONAL DATA AND INFORMATION OWNED BY SUCH THIRD PARTIES, AND YOU ACKNOWLEDGE THAT YOU ARE THE CONTROLLER OF SUCH THIRD PARTIES' PERSONAL DATA AND THAT DORIS.MOBI WILL ACT SOLELY AS AN OPERATOR, PURSUANT TO APPLICABLE LAW.

YOU DECLARE THAT YOU ARE RESPONSIBLE FOR ALL CONTENT THAT YOU TRANSMIT TO/THROUGH DORIS AND DECLARE THAT YOU ARE AWARE THAT, UNLESS LIMITED BY PRIVACY SETTINGS, SUCH CONTENT WILL BE AVAILABLE TO THE ENTIRE DORIS COMMUNITY AND MAY BE SHARED INSIDE AND OUTSIDE THE DORIS COMMUNITY OR USED BY OTHER USERS.

THE PROCESSING OF YOUR PERSONAL DATA, AS WELL AS THOSE OWNED BY THIRD PARTIES, BY DORIS.MOBI, IN ACCORDANCE WITH THIS POLICY AND APPLICABLE LAW, IS A CONDITION FOR YOU TO VALIDLY REGISTER IN DORIS AND START USING THE SERVICES OFFERED BY DORIS.MOBI THROUGH DORIS. THEREFORE, IF YOU DO NOT PROVIDE YOUR CONSENT FOR DORIS.MOBI TO PROCESS YOUR PERSONAL DATA IN ACCORDANCE WITH THIS POLICY AND APPLICABLE LAW, YOU CANNOT REGISTER IN DORIS, CREATE A DORIS ACCOUNT, AND/OR ENJOY THE SERVICES OFFERED BY DORIS.MOBI.

TO EXERCISE ANY OF YOUR RIGHTS UNDER THIS POLICY AND/OR APPLICABLE LAW, REGARDING YOUR PERSONAL DATA, OR TO REVOKE THE CONSENT GRANTED HERE, YOU OR THE THIRD-PARTY OWNER OF THE PERSONAL DATA MUST CONTACT OUR SUPPORT.
 

Processing of User's Personal Data

Collection of Personal Data. For the purpose of registration and use of Doris, you provide Doris.MOBI with certain Personal Data, such as name, gender (optional), phone number, and image (optional), among other Personal Data of yours.

When you use Doris' features and/or interact with other users of the Doris Community, whether by viewing and/or reacting to other users' content, exchanging messages, comments, among others, Doris.MOBI collects your information and Personal Data to identify your preferences and interests. Based on them, Doris creates your style profile, which will be used by Doris to provide our services (such as suggesting clothing combinations to you) and to determine some of the ads that will be displayed.

Messages exchanged between users through Doris are end-to-end encrypted, meaning that Doris.MOBI cannot read or access their content.

Through Doris.MOBI systems, it is possible to associate your account with the technological features used by you, such as operating system version, hardware model, unique product identifiers, mobile network information, and phone number.

When you use a Doris.MOBI service is capable of identifying your location, Doris.MOBI may collect and process real-time location-related information and Personal Data. The location data may be used by Doris.MOBI to indicate to you the nearest places where clothing items of your interest are sold, among other applications.

Processing of Personal Data: Once Doris.MOBI has received and/or collected your Personal Data, Doris.MOBI starts processing such Personal Data, especially, but not limited to, concerning operations of classification, usage, access, reproduction, transmission, sharing, processing, archiving, storage, deletion, evaluation, or control and communication.

Purpose of Processing: Doris.MOBI processes your data for the purpose of (a) allowing you to use the services offered by Doris.MOBI through Doris; (b) fulfilling the obligations assumed by Doris.MOBI under the Terms of Use and requiring you to fulfill your obligations under the Terms of Use; (c) enhancing your experience on Doris; (d) maintaining, protecting, and improving the services provided; and (e) identifying your preferences to present you with ads that may interest you.

The collected information enables Doris.MOBI to communicate with you, notifying you of available security updates or providing support for your experience on Doris.

Doris.MOBI will not process your Personal Data for purposes other than those established in this Policy, and such processing will be limited to the minimum necessary for achieving these purposes.

Doris.MOBI uses your data to target ads that may interest you, but it does not sell or otherwise commercialize your Personal Data to advertisers and does not share personally identifiable information (such as name, email address, or other contact information) with advertisers unless it receives specific permission from you.

You hereby agree that if Doris.MOBI is involved in a merger, acquisition, or sale, Doris.MOBI may transfer your Personal Data, and as required by Applicable Law, Doris.MOBI will notify you of such transfer, and you may, if you disagree with the changes, revoke the consent given to Doris.MOBI for the processing of your Personal Data in accordance with this Policy.

Legal Basis for Processing Personal Data: Without prejudice to the express consent given by you for Doris.MOBI to process your Personal Data in accordance with this Policy and Applicable Law, you acknowledge and agree that Doris.MOBI's processing of your Personal Data is based on the necessity for the performance of the contract between Doris.MOBI and you, represented by the Terms of Use, and to further Doris.MOBI's legitimate interests, subject to your rights and fundamental freedoms that require the protection of your Personal Data.

You further acknowledge and agree that Doris.MOBI's processing of your Personal Data may, as applicable, be based on the need to comply with a legal or regulatory obligation by Doris.MOBI, as applicable.

Controller. Doris.MOBI (DORIS.MOBI TECNOLOGIA S.A., headquartered in the City of São Paulo, State of São Paulo, at Avenida Brigadeiro Faria Lima, No. 2,092, 10th floor, suites E102 and E104, room 02, Jardim Paulistano, ZIP Code 01451-905, registered under CNPJ No. 19,782,186/0001-06) is the Controller of the Processing of your Personal Data and is responsible for making decisions regarding the Processing of your Personal Data. Doris.MOBI will keep a record of all operations of Processing of your Personal Data that it performs.

Controller's Contact Information. You can contact Doris.MOBI (Controller of the Processing of your Personal Data) through one of the communication channels that are part of our Support.

Operators. The identification of the Operators, i.e., those responsible for Processing Personal Data on behalf of Doris.MOBI, and in accordance with Doris.MOBI's guidelines, instructions, and decisions, in harmony with this Policy and in accordance with the security and confidentiality measures established by Doris.MOBI, is protected by trade secrets and/or industrial secrets, as applicable under Applicable Law.

Responsibilities of Operators. To the extent legally applicable, Operators shall, with respect to the protection of your Personal Data:

- Maintain a record of the Processing operations of your Personal Data that they perform.

- Comply with any and all Applicable Law.

- Detect, prevent, and abort any fraud, technical violations, and security breaches.

- Protect Doris.MOBI, you, and the general public, as requested and permitted by Applicable Law, against harm to rights, property, and safety.

Data Disclosed by Third Parties About You. Doris.MOBI may receive your Personal Data through the provision by other users, such as receiving your image sent by another user. Upon receiving this type of Content, Doris.MOBI will act solely as the Operator of your Personal Data, acting within the limits of the current legislation.

Data of Third Parties Disclosed by You. Doris.MOBI may receive Personal Data from third parties through Content generated by you. To generate Content containing Personal Data of third parties, you must obtain the prior and express consent of the holder of such Personal Data, declaring yourself to Doris.MOBI as the legitimate Controller of the Personal Data of third parties. In this case, Doris.MOBI will act solely as the Operator of the Personal Data of the respective third parties, acting within the limits of the current legislation.

International Transfer of Personal Data. Doris.MOBI does not perform international transfer of Personal Data.

Support. Support is the channel responsible for (a) receiving your complaints and communications, as well as providing clarifications and taking action regarding the Processing of your Personal Data; and (b) guiding Doris.MOBI employees and contractors regarding the practices to be taken in relation to the Processing and protection of Personal Data.

Shared Use of Personal Data. Doris.MOBI does not share your Personal Data.

Sensitive Personal Data. Doris.MOBI does not request Sensitive Personal Data from you and does not process Sensitive Personal Data. If Doris.MOBI identifies that any Sensitive Personal Data has been transmitted by you to Doris, Doris.MOBI reserves the right to promote the Deletion of said Sensitive Personal Data, subject to the provisions of Applicable Law.

To register with Doris and use the services provided by Doris.MOBI, if you are under 18 (eighteen) years old and/or not legally capable, you must be assisted or represented by your parents or legal guardians, who must authorize the Processing of your Personal Data in accordance with the Terms of Use, this Policy, and Applicable Law.

In any case where Doris.MOBI identifies a child or adolescent's Personal Data that does not comply with this Policy and Applicable Law, such as in the case of fraud in registering with Doris by the user, Doris.MOBI may terminate your account that has transmitted said Personal Data and take other appropriate actions.Start of Personal Data Processing. Doris.MOBI will process your Personal Data from your registration on Doris, upon your agreement with the Terms of Use and this Policy.

Doris.MOBI will terminate the Processing operations of your Personal Data (except for archiving and storage operations) in the following situations:

- In case of closure of your account, provided that all rights and obligations established between Doris.MOBI and you due to the Terms of Use and/or Applicable Law are definitively extinguished.

- If you revoke the consent granted herein or request the termination of Processing, in which case your account will be automatically terminated.

- In case of an order from a competent Government Authority or, also, in accordance with Applicable Law.

Once the Processing operations of your Personal Data (except for archiving and storage operations) are terminated as established above, Doris.MOBI will promote the Deletion of your Personal Data, within the technical scope and limits of its activities. The archiving and storage of your Personal Data are authorized (a) for the purpose of complying with a legal or regulatory obligation by Doris.MOBI; and/or (b) until the legal deadline for Doris.MOBI and/or you to claim any of your rights established in the Terms of Use and/or Applicable Law has expired; and/or (c) for the exclusive use of Doris.MOBI, provided that Doris.MOBI makes the Personal Data become Anonymized Data.

Anonymized Data. Doris.MOBI may anonymize your Personal Data, making it Anonymized Data. You acknowledge and agree that Anonymized Data is not considered Personal Data, except if the anonymization process to which they were submitted is reversed, using exclusively Doris.MOBI's own means, or when, with reasonable efforts (under Applicable Law), it can be reversed.

In this sense, you acknowledge and agree that Anonymized Data will not be subject to the protections established in this Policy, and Doris.MOBI may publicly disclose Anonymized Data, including, but not limited to, for the purpose of displaying trends about the use of Doris.MOBI's services.

Changes. In the event of a change in the purpose, form, duration, and/or Controller of the Processing of your Personal Data or if Doris.MOBI wishes to share your Personal Data, Doris.MOBI will inform you of the fact, specifically highlighting the nature of the changes, and you may, if you disagree with the changes, revoke the consent given to Doris.MOBI for the Processing of your Personal Data, in accordance with this Policy.
 

Your Rights Regarding Your Personal Data

Doris.MOBI ensures your right to consult it, facilitated and free of charge, through one of the communication channels that are part of our Support, about (a) the form and duration of the Processing of Your Personal Data; and (b) Doris.MOBI and the Operators, subject to trade secrets and industrial secrets.

At any time, you can obtain confirmation from Doris.MOBI of the existence of the Processing of Your Personal Data, as well as access to Your Personal Data held by Doris.MOBI.

Such confirmation and/or access will be provided by Doris.MOBI, upon your request, (a) in a simplified format, immediately; or (b) through a clear and complete statement that indicates the origin of the Personal Data, the absence of a record, the criteria used, and the purpose of the Processing, subject to trade secrets and industrial secrets of Doris.MOBI, provided within up to 15 (fifteen) business days from the date of your request.

The information will be provided by Doris.MOBI (a) electronically, securely, and suitably for this purpose; or (b) in printed form, according to your preference.
Doris.MOBI will store your Personal Data in a format that facilitates the exercise of your right to access. You can request a complete electronic copy of your stored Personal Data, subject to the trade secrets and industrial secrets of Doris.MOBI and the terms of the Applicable Law, in a format that allows its subsequent use, including in other Processing operations.

You also have the right to obtain from Doris.MOBI, regarding your Personal Data being Processed, at any time and upon request in this regard:

- The correction of incomplete, inaccurate, or outdated Personal Data, provided that you guarantee and are responsible for the truthfulness, accuracy, validity, and authenticity of the Personal Data you enter or update in Doris, committing to keep them duly updated at all times;

- The anonymization, blocking, or deletion of unnecessary, excessive, or Personal Data processed in non-compliance with the provisions of the Applicable Law;

-  Deletion of Your Personal Data, with the right of Doris.MOBI, in this case, to close your Account and archive and store the Personal Data (a) for the purpose of complying with a legal or regulatory obligation by Doris.MOBI; and/or (b) until the legal deadline for Doris.MOBI and/or you to claim any of your rights established in the Terms of Use and/or the Applicable Law has expired; and/or, still, (c) for the exclusive use of Doris.MOBI, provided that Doris.MOBI makes the Personal Data become Anonymized Data; and

- Information about the possibility of not providing consent and about the consequences of refusal.

Finally, you have the right to, at any time, revoke the consent given to Doris.MOBI for the Processing of Your Personal Data, or request the termination of the Processing. In these cases:

- Your Account will be automatically closed;

- The Processing operations of Your Personal Data (except for archiving and storage operations) will be terminated; and
‍
- Doris.MOBI will promote the Deletion of Your Personal Data, within the technical scope and limits of its activities. You are hereby authorized to archive and store Your Personal Data (a) for the purpose of complying with a legal or regulatory obligation by Doris.MOBI; and/or (b) until the legal deadline for Doris.MOBI and/or you to claim any of your rights established in the Terms of Use and/or the Applicable Law has expired; and/or, still, (c) for the exclusive use of Doris.MOBI, provided that Doris.MOBI makes the Personal Data become Anonymized Data.
 

Privacy, Protection, and Security of Personal Data

Doris.MOBI considers your Personal Data valuable and understands that it must be protected from unauthorized access, accidental or unlawful destruction, loss, alteration, communication, or any form of inadequate or illegal Processing, in accordance with the Applicable Law.

In this regard, Doris.MOBI will adopt suitable security measures, both technical and administrative, (a) to protect your Personal Data to the maximum extent possible and in accordance with accepted market standards, from unauthorized access and accidental or unlawful destruction, loss, alteration, communication, or any form of inadequate or illegal Processing; and (b) to prevent damages resulting from the Processing of Personal Data carried out by Doris.MOBI.

When Processing Your Personal Data, Doris.MOBI shall ensure compliance with security and confidentiality standards for records, Personal Data, and private communications, in accordance with the Applicable Law, observing, at the minimum, the following security guidelines:

- Establishment of strict control over access to Personal Data, by defining the responsibilities of individuals who will have access and exclusive access privileges for certain individuals;

- Provision of access authentication mechanisms to records, using, for example, dual authentication systems to ensure the individualization of the person responsible for Processing the records;

- Creation of a detailed inventory of accesses to connection records and application accesses, containing the time, duration, identity of the person responsible for access designated by Doris.MOBI, and the accessed file; and

- Use of record management solutions through techniques that ensure the inviolability of Personal Data, such as encryption or equivalent protection measures.

Doris.MOBI will keep the respective access records to Internet applications confidential, in a controlled and secure environment, for a minimum period of 6 (six) months from their collection.

Considering that the Internet is not a completely secure environment, Doris.MOBI cannot ensure or guarantee that your Personal Data will not be accessed, disclosed, altered, or destroyed by a breach of any of the security protections, technical or administrative, employed by Doris.MOBI, even if such protections are adequate to accepted market standards. Nevertheless, Doris.MOBI will make its best efforts to preserve the confidentiality and security of the Personal Data provided by you to Doris. In this sense, Doris.MOBI will not share, sell, or in any other way provide your Personal Data to third parties without your prior authorization, except:

- In cases authorized by this Policy, such as, for example, in the case of sharing Personal Data with the Operator;

Doris.MOBI will not be responsible for any damages incurred by You due to third parties violating its servers by subverting Doris.MOBI's security systems to access this information. Furthermore, Doris.MOBI assumes no responsibility for the content of third parties (including, without limitations, any viruses or other disabling elements) that may affect Doris or your use thereof, nor does it assume any obligation to monitor such content.

Doris.MOBI is expressly authorized, whenever it deems necessary, to confirm the Personal Data provided by You and consult public entities, specialized companies, or Databases, to the maximum extent allowed by the Applicable Law. The information obtained from these entities by Doris.MOBI will be treated confidentially, in accordance with this Policy.

By using Doris, You acknowledge and agree that small files, known as "cookies," "pixel tags," "flash cookies," or other means of local storage provided by Your browser or associated applications, will be placed on your computer's hard drive or mobile device for the purpose of allowing You to be recognized by Doris on new accesses, so that Doris.MOBI can remember Your preferences and choices, helping you use Doris effectively and efficiently. You are free to refuse these files if your browser or add-on allows, unless these files are necessary to prevent fraud or ensure the security of Doris. Remember that refusing these files may interfere with the use of Doris.

Doris.MOBI may, at any time, communicate with You by SMS or by any other form of contact, (a) relevant information or changes regarding Your registration and your use of Doris; (b) reminders; and/or (c) offers and promotions for the use of Doris. In some circumstances, the websites and/or applications integrated into Doris may allow the sending and/or transmission of Content by You, such as suggestions, comments, messages, photographs, videos, texts, etc., for disclosure in open content areas of Doris.

Regarding the situation described here, You declare to be aware of and agree that: (a) the identification information of Your profile, as well as any contents sent/transmitted by You, as described above, may be accessed and viewed by any other Users and visitors of Doris; and (b) the Contents sent/transmitted by You will be Your full and exclusive responsibility, committing to indemnify and hold Doris.MOBI harmless regarding any liabilities, demands, and/or damages that may arise from the contents sent/transmitted by You.

You are aware that: (a) Doris may contain links to third-party websites, (b) such third-party sites are not the responsibility of Doris.MOBI, and (c) by browsing such sites, You will be subject to their respective terms of use and privacy policies.
 

Other Provisions

Requests from Government Authorities: Doris.MOBI collaborates with Government Authorities to ensure compliance with Applicable Laws, protect the integrity and security of Doris and its Users, prevent illegal activities, protect industrial and intellectual property rights, and prevent fraud. Whenever requested by Government Authorities, Doris.MOBI will provide Your Personal Data (including, without limitation, name and address).

Compliance with Legal or Regulatory Obligations by Doris.MOBI: Without prejudice to, and in addition to the above, Doris.MOBI may perform any Personal Data Processing operations to comply with a legal or regulatory obligation to which Doris.MOBI is subject, without limiting other Processing scenarios provided for in the Applicable Law and this Policy. In these cases, Doris.MOBI will inform You about the situations in which the Processing of Your Personal Data is allowed.

Changes to this Policy: Doris.MOBI reserves the right to change this Policy at any time, with changes taking effect immediately upon their disclosure or, if Your consent to the altered content is required, upon Your agreement. International Visitors: Our services are provided in Brazil and are intended for individuals located in Brazil. If You reside in Europe and/or are accessing Doris in Europe or other regions where laws regarding the protection and use of Personal Data differ from Brazilian laws, You hereby acknowledge being aware that the Processing of Your Personal Data will be conducted in accordance with Brazilian legislation. Brazil does not have Personal Data protection and Processing laws similar to those of the European Union or other jurisdictions. By providing Your Personal Data to Doris.MOBI, You consent to the Processing of said Personal Data in accordance with this Policy and the Applicable Brazilian Law.

The nullity or invalidity of any provision of this Policy shall not imply the nullity or invalidity of the others.
